1. Scope and Provider

These Terms of Service (“Terms”) govern your use of the website tyff.me and the TYFF platform (“Thank You For Failing”), operated by:

By accessing or using TYFF, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

2. Description of Service

TYFF is a free community platform that helps entrepreneurs build failure tolerance. It offers an interactive quiz (“Spice Test”), a community story wall (“Spice Wall”), and educational content. The service is provided free of charge. No user account or registration is required to use TYFF.

3. Eligibility

TYFF is intended for users aged 16 and older. By using the platform, you confirm that you are at least 16 years of age. If you are under 16, you may only use TYFF with the consent of a parent or legal guardian.

4. User Content

When you submit a story to the Spice Wall, you:

  • Grant FRYR UG a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your story on the TYFF platform and associated social media channels for the purpose of operating the service.
  • Confirm the story is your own experience or you have permission to share it.
  • Agree that your story may be moderated or removed if it violates these Terms.
  • Retain full ownership of your content. You can request removal of your story at any time by emailing hello@tyff.me. Upon removal, the licence granted above terminates.

5. Acceptable Use

You agree not to:

  • Submit content that is hateful, threatening, harassing, defamatory, or illegal.
  • Share personally identifiable information of others without their consent.
  • Use the platform for spam, advertising, or commercial solicitation.
  • Attempt to circumvent our content filters or rate limits.
  • Use automated tools to scrape or extract data from the platform.
  • Interfere with or disrupt the security, integrity, or performance of the service.

We reserve the right to remove content and restrict access to users who violate these rules without prior notice.

6. Content Moderation

Stories are published immediately upon submission, subject to automated content filtering (keyword-based, not AI). Flagged content is reviewed by a human moderator. We reserve the right to remove any content that violates these Terms or applicable law. Moderation decisions are made at our reasonable discretion.

7. Quiz and Spice Levels

The TYFF Spice Test is for entertainment and community purposes only. Spice level results are not professional assessments, psychological evaluations, or coaching advice and should not be treated as such. No decisions should be made based solely on quiz results.

8. Intellectual Property

All content, design, branding, and code of the TYFF platform (excluding user-submitted stories) are the intellectual property of FRYR UG or its licensors and are protected by German and international copyright law. You may not reproduce, distribute, or create derivative works from platform content without prior written consent.

9. Liability

FRYR UG is liable without limitation for damages caused intentionally or through gross negligence, and for damages resulting from injury to life, body, or health. For slight negligence, FRYR UG is only liable for breach of material contractual obligations (Kardinalpflichten), limited to foreseeable, typically occurring damages.

FRYR UG assumes no liability for the content of user-submitted stories. The availability of the platform is provided on a best-effort basis without guarantees of uninterrupted access. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

10. Data Protection

Your privacy is important to us. Details on how we collect, process, and protect your personal data are set out in our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer within the EU, you also benefit from mandatory consumer protection provisions of your country of residence.

For merchants (Kaufleute), legal entities under public law, or special public-law funds, the exclusive place of jurisdiction is Köln, Germany. For consumers, statutory jurisdiction rules apply.

12. Changes to These Terms

We may update these Terms from time to time. The current version is always available at tyff.me/terms. Material changes will be communicated through a notice on the website. Continued use of the platform after changes constitutes acceptance of the updated Terms. If you do not agree with changes, please discontinue use of the platform.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original provision.
